TERMS & CONDITIONS FOR TUTORS
Key points:
1. Captain Tutor will charge a commission of 50% of the fees for the first month (usually the fees for first 4 / 8 / 12 lesson) from you for each successful assignment, which we will collect from the client. You will teach at the place designated by the student / parent.
2. Please be truthful about your qualifications as parents may request to see relevant certificates on the first lesson.
3. By registering with our agency, you declare to be free of criminal records and are not being charged with any offence in a court of law in Singapore (excluding parking offences).
4. Your basic profile will be displayed in our 'Search Tutors' page for parents to shortlist, where certain information is shown (name, age, gender, schools attended, experience, commitment, and photo). Personal details such as your phone number, email, address will not be displayed. If you wish to unsubscribe or remove your details, please contact us immediately.
Registration
Registering as a tutor with Captain Tutor is free. The minimum age is 18 years old. Captain Tutor reserves the right to reject your application.
All content created by the tutor such as text, photographs, graphics and messages are the sole responsibility of the tutor. Therefore, you are entirely responsible for all content that you post, upload, email or make available via Captain Tutor's website.
The certificates that you upload on our registration form is solely for the administrator to verify the accuracy of your qualifications and will not be sent to parents or any other third-party.
You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account or password.
Captain Tutor cannot and will not be liable for any loss or damage arising from your registration as a tutor. Captain Tutor reserves the right to terminate accounts or edit and remove content in your Tutor account. Captain Tutor is not held liable for any unforeseen circumstances that may arise from the assignment.
Contacting you for assignments
You may receive a call or SMS broadcasts for new assignments and first lesson reminders. However, Captain Tutor cannot guarantee that you will receive SMS broadcasts as it is dependent on your profile and client's preferences.
After you have responded to the SMS broadcast, Captain Tutor does not guarantee that you will be selected for the assignment.
If you are shortlisted, we will contact you for further discussion. If you are not selected, we have no obligation to contact you.
First Lesson and Assignment
You are expected to contact the client before the first lesson, for re-confirmation of the lesson.
Failure to turn up for the first lesson or any other personal reasons resulting in the cancellation of the assignment will lead to the termination of your tutor account. This will be evaluated on a case-by-case basis.
The client can stop the tuition at any time. You can expect to receive payment for any number of lessons rendered, unless the client is dissatisfied with the lesson.
If the assignment is cancelled immediately after the first lesson for any reason whatsoever, please refer to the next section on 'Commission' for the settlement of the commission.
Commission
The fees are fixed for the first month. No negotiation is allowed once the fees have been agreed upon.
Captain Tutor will collect 50% from the first month as commission at the end of the 2nd week's lessons. It may be from the completion of 4, 8 or 12 lessons (depending on the frequency of the tuition assignment).
If lessons are postponed during the 4-weeks, the postponed lessons will not be counted in the commission. Example: During 4 weeks with a total of 8 lessons, 1 lesson was postponed by the client. Captain Tutor will still collect commission, based on 8 lessons and not 7 lessons.
If there are any changes to the frequency of lessons within the first or second month, the commission collected will vary based on whether the frequency was increased or decreased. The commission will be negotiated on a case-by-case basis.
Any unreasonable demands or attempt to avoid payment of the commission will result in the termination of your account.
Captain Tutor will not collect any upfront payment from the client and we do not allow instalment plans.
Cancellation by tutor OR if the client cancels due to tutor’s fault:
If tutor cancels the assignment during the first month of tuition, the tutor will still pay the commission, which is equivalent to 50% of the first 4 / 8 / 12 / 16 lessons as stated in the confirmation SMS. Any surplus beyond the first 50% of the tuition fees will then be paid to the tutor.
Cancellation by client (no fault of tutor):
If client cancels the assignment during the first month of tuition, the tuition fees will be collected by the agency and divided equally between the agency and the tutor.
Conduct of Tutor
Although Captain Tutor has no legal jurisdiction over the conduct of their tutors, certain penalties will be imposed on tutors who display poor conduct.
Certain areas to highlight:
Punctuality. If the client complains that the tutor frequently arrives late or leaves before the lesson is completed, Captain Tutor has the right to stop the assignment and/or close the tutor's account at any time.
'No-shows'. As we treat ‘no-show’s severely, tutors who did not turn up for the lesson without informing the client, through a phone call or in person, will have their account closed. SMS or emails are not considered as legitimate means for informing the client.
Be professional. Tutors must always concentrate on their lessons. If a client complains that the tutor is frequently distracted (for example, doing personal tasks, messaging, chatting), a warning will be issued to the tutor. Captain Tutor may stop the assignment and/or close the tutor's account at any time.
Dress code. Bear in mind that the client has the right to reject a tutor due to his/her inappropriate dressing. Therefore, please dress appropriately at all times.
Captain Tutor will try our utmost to be fair to the tutor. Any complaints lodged against the tutors will be investigated. We will also seek clarification from the tutor, to allow the tutor to defend himself / herself.

PERSONAL DATA PROTECTION ACT
Starting from January 2014, the Do Not Call (DNC) provisions under the Personal Data Protection Act (PDPA) generally prohibits organisations from sending certain marketing messages (in form of voice calls, text or fax messages) to Singapore telephone numbers, including mobile, fixed-line, residential and business numbers, registered with the DNC Registry.
Please be assured that Captain Tutor considers the privacy of your personal information as utmost importance. Personal information includes but is not limited to your name, telephone number, handphone number, email address, home address and any other information you have provided to Captain Tutor.
By providing your personal information to us, you therefore give consent to receiving phone calls, SMSes or emails from our coordinators in the tuition-matching process. Captain Tutor understands that our tutors care about how their personal information is used and shared. We appreciate your trust that we will do so carefully and sensibly.
